USER AGREEMENT OF THE KMAIL DIGITAL SERVICE

1. GENERAL PROVISIONS
1.1. This User Agreement (hereinafter — the "Agreement") defines the terms of use and development of the Kmail Digital Service (hereinafter — the "Service"), the rights holder of which is the Public Foundation for the Development of Artificial Intelligence and Digital Economy.
1.2. Use of the Service is governed by this Agreement, the Privacy Policy and Personal Data Processing Policy, as well as the Rules of Use, which are an integral part of this document.
1.3. Upon registration, each access, or actual use of the mailbox, the User confirms that they have fully read and agree to the terms of the Agreement, the Policy, and the Rules.
2. SUBJECT OF THE AGREEMENT
2.1. The Service provides the User with access to a personal electronic mailbox with a unique email address for receiving, sending, and storing electronic messages and attachments.
2.2. The Service is exclusively a tool for exchanging mail correspondence. Additional services are not provided under this Agreement.
3. USER RIGHTS AND OBLIGATIONS
3.1. The User has the right to:
- 3.1.1. Use the functional capabilities of the Service for personal and business correspondence.
- 3.1.3. Contact the Service support team in case of technical problems.
3.2. The User is obliged to:
- 3.2.1. Provide accurate and up-to-date information during registration.
- 3.2.2. Ensure the confidentiality of their password. Any actions performed using the User's login and password are deemed to have been performed by the User personally.
- 3.2.3. Immediately notify the Service of any unauthorized access to the account.
- 3.2.4. Use the Service only for lawful purposes. Not use mail for sending spam, phishing, viruses, and materials that violate the legislation of the Kyrgyz Republic.
- 3.2.5. Comply with the technical limits of the Service (mailbox volume, attachment size, number of outgoing messages per day, etc.).
4. SERVICE RIGHTS AND OBLIGATIONS
4.1. The Service has the right to:
- 4.1.1. Unilaterally change the terms of this Agreement and establish new technical restrictions.
- 4.1.2. Block User access or delete the electronic mailbox in case of violation of the terms of the Agreement, including in case of spam mailings or use of mail for fraud, without prior notice.
- 4.1.3. Carry out technical and preventive maintenance, during which the Service may be temporarily unavailable.
- 4.1.4. Delete messages and files that are recognized by automatic filters as malicious or spam.
4.2. The Service is obliged to:
- 4.2.1. Ensure the technical functioning of the Service and the User's access to their mailbox, provided that the User complies with this Agreement.
- 4.2.2. Observe the privacy of the User's correspondence, except in cases provided for by the legislation of the Kyrgyz Republic.
- 4.2.3. Ensure the protection of the User's personal data in accordance with the Privacy Policy and Personal Data Processing Policy and the requirements of the legislation of the Kyrgyz Republic.
- 4.2.4. Timely consider User inquiries submitted through official communication channels.
5. CONFIDENTIALITY AND PERSONAL DATA
5.1. The procedure for collecting, storing, and protecting information, as well as the purposes and legal grounds for processing User data, are governed by the Privacy Policy and Personal Data Processing Policy.
5.2. The User gives consent to the automatic processing of their messages by Service programs solely for filtering unwanted mail (spam) and detecting viruses. The Service guarantees that such processing does not involve human review of the content of correspondence.
5.3. The Service is obliged to store information about the facts of receipt, transmission, and processing of messages and to provide it to authorized government bodies in accordance with the requirements of the legislation of the Kyrgyz Republic.
6. LIMITATION OF LIABILITY
6.1. The Service does not guarantee uninterrupted and error-free operation of the software, nor the absence of technical failures, delays, data loss, or server unavailability.
6.2. The Service is not liable for:
- Any losses, damages, or consequences arising from unauthorized access to the User's account, including password compromise due to third parties or the User themselves.
- Delays in mail delivery caused by failures in the operation of internet providers or other mail services, or other third parties.
- Actions of third parties, including hacking, phishing, malicious software, or other forms of unauthorized access.
- Loss, distortion, or untimely delivery of electronic messages that occurred for reasons beyond the control of the Service.
6.3. The User is independently liable to third parties for the content of messages sent by them.
6.4. The User is independently liable for the content, legality, and consequences of sent messages, including liability to third parties, as well as for compliance with applicable legislation.
6.5. The Service is not liable for the content of electronic messages sent or received by Users, nor for possible use of the Service for unlawful purposes by third parties without fault on the part of the Service.
7. FINAL PROVISIONS
7.1. All disputes arising from this Agreement shall be resolved through negotiations. The response period for a written claim from the User is 30 calendar days.
7.2. If negotiations do not lead to a result, the dispute shall be considered in court at the location of the Service in accordance with the legislation of the Kyrgyz Republic.
7.3. Invalidity of one provision of the Agreement does not entail invalidity of its remaining provisions.
